3 March 2004 -- GCLA Legislative Update -- Missouri LegislatureWe have fought hard for thirteen years now. We have not gone away. Nor will we.
After winning final approval. and overriding a gubernatorial veto. and being delayed by the Newman/Miller show. and coming away from the MOSC with a good portion of our law intact minus some "funding" issues. it will NOW BE OUR JOB TO PRESERVE AND PROTECT our new LTC law but also to protect the other facets of our limited firearm owning rights.
What follows is a list of proposed bills that have been filed in the Missouri State Senate and Missouri State House. Some deal with gutting or injuring our new LTC law. Some deal with other issues that the anti-gun-owning organizations promote such as "lock up your safety" laws.
The list includes the Bill number [SB stands for "Senate Bill" and HB stands for "House Bill"], if GCLA "supports" or "opposes" the bill, the Sponsor, and IF the bill has been assigned to committee.
In some cases, I have provided a very brief reason on why we are opposed to the legislation.
Here is the list starting with the Senate Bills:
Senate Bills
1) SB 0890. [OPPOSE] -- Restricts the use, possession, manufacturing, storage, selling, promotion and other activities relating to weapons http://www.house.mo.gov/bills041/bills/sb890.htm Sponsor:. Bland. Committee:. Judiciary and Civil & Criminal Jurisprudence.
The bill in part states:
"(5) "Gun show or an event", a function sponsored by any national, state, or local organization, devoted to the collection, competitive use, or other sporting use of firearms, or an organization or association that sponsors functions devoted to the collection, competitive use, or other sporting use of firearms in the community;"
Please note that the definition of "gun show or event" is so broadly written that a rural high school 4H shooting club may have to file with the Department of Public Safety for permission to hold its events, post a million dollar bond, get background checks on participants/"vendors"... etc. So will Big Game Hunters, Ducks Unlimited, GCLA, WMSA, MPS.
Also please NOTE that the "event" is NOT required to have anything to do with SELLING or TRANSFERRING firearms. Just be held by a group that supports/promotes gun ownership or use.
There are many other nasty anti-gun-owning provisions in this bill. I will not detail them all in this email.

2) SB 0898. [OPPOSE] -- Prohibits sale of firearms without a trigger locking device. Sponsor:. Bland http://www.house.mo.gov/bills041/bills/sb898.htm Committee:. Judiciary and Civil & Criminal Jurisprudence.
Contact the members of the Senate's Judiciary and Civil & Criminal Jurisprudence committee and POLITELY ask them to kill this bill.
3) SB 0939. [OPPOSE] -- Limits ability to carry a concealed weapon in a passenger compartment to those with a concealed carry endorsement. http://www.house.mo.gov/bills041/bills/sb939.htm Sponsor:. Coleman. Committee:. Judiciary and Civil & Criminal Jurisprudence.
This bill would limit the "car carry" provisions of HB349 to LTC permit holders. Somehow, "open" carry of firearms in cars is safe, but "concealed" carry is dangerous.
Contact the members of the Senate's Judiciary and Civil & Criminal Jurisprudence committee and POLITELY ask them to kill this bill. It is an UNNECESSARY revision to our new law.
4) SB 0946. [OPPOSE] -- Creates the crime of negligent storage of a firearm. Sponsor: Bray. http://www.house.mo.gov/bills041/bills/sb946.htm Committee:. Judiciary and Civil & Criminal Jurisprudence.
Another rendition of the "lock-up-your-safety" law.
The bill reads in part:
"571.023. 1. A person commits the crime of criminally negligent storage of a firearm if:
(1) Such person stores or keeps any loaded firearm or unloaded firearm and ammunition for that firearm on any premises under his or her custody and control;
(2) He or she knows or reasonably should know that a minor is capable of gaining access to the loaded firearm or unloaded firearm and ammunition; and
(3) A minor obtains the loaded firearm or unloaded firearm and ammunition and uses it to cause the death of any person or exhibits the firearm in a public place or uses it to threaten injury or death to any person."
Besides being asked to render your home safety equipment ineffective, you could be charged with a crime if a "minor" gains possession and "exhibits" the firearm in a public place. Note. they don't have threaten anyone, just simply show it and you get charged with a crime.

5) SB 1314. [OPPOSE] -- Creates provisions concerning domestic assault. Sponsor:. Bray. http://www.house.mo.gov/bills041/bills/sb1314.htm Committee:. Judiciary and Civil & Criminal Jurisprudence.
Being convicted of shouting at your spouse could prohibit you from possessing firearms. Violation of this provision would be a Class D FELONY. PLUS. this bill could force women who are being abused to surrender their firearms just when they might need them the most.

6) SB 1332. [SUPPORT] -- Allows sheriffs to pay the costs of issuing concealed carry endorsements with sheriff's revolving fund money. http://www.house.mo.gov/bills041/bills/sb1332.htm Sponsor:. Caskey.
This bill will "fix" the Hancock funding problem of HB349 et al as passed.
